Introduction
Welcome to Cramly. These Terms of Service ("Terms") govern your use of the Cramly mobile application (the "App") and any related services provided by Cramly Inc. By accessing or using our App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
Account Registration
To use the App, you must sign in using either your Google or Apple account. By using these authentication methods, you agree that the information provided through your chosen authentication provider is accurate and current. You are responsible for maintaining the security of your Google or Apple account and for all activities that occur under your account. We recommend enabling two-factor authentication on your authentication provider's account for additional security.
Recording Policy
Users must comply with institutional policies and obtain necessary permissions before recording or sharing content. This includes adherence to your organization's rules regarding lecture recordings and educational content sharing. You must respect copyright laws and obtain explicit permission before recording or uploading protected content. Recording or sharing sensitive information that violates privacy laws is prohibited. Cramly is not liable for unauthorized recordings or content uploads that violate institutional policies, copyright, or privacy laws. Users are solely responsible for ensuring compliance with all applicable regulations.
User Content
Our App allows you to create, upload, and share content. You retain all rights to your content, but you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, modify, publicly display, and distribute such content in connection with our services. You represent and warrant that you own or have the necessary rights to your content and that it does not violate the rights of any third party.
Subscription and Billing
Some features of the App require a subscription. When you subscribe, you agree to pay the fees indicated for your selected subscription plan. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can cancel your subscription through your app store account settings. Refunds are subject to the policies of the respective app store.
Intellectual Property
The App and its original content, features, and functionality are owned by Cramly Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as permitted by these Terms.
Limitation of Liability
In no event shall Cramly Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the App or delete your account.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
